1. Agreement to Terms

By accessing or using Subtitle Pro ("the App"), including any associated features and services, you agree to be bound by these Terms and Conditions ("Terms"). The App is provided by Subtitle Pro ("we," "us," or "our") and integrates with Canva to provide automated subtitle generation services. If you do not agree to these Terms, do not use the App.

2. Service Description and Acceptance

Subtitle Pro provides automated subtitle generation services through Canva's platform. By using our App, you acknowledge and agree that:

• The App uses automated processes to generate subtitles for your videos
• Subtitle accuracy may vary based on various factors including audio quality, background noise, and speech clarity
• Processing times vary based on video length, quality, and server load
• The App requires Canva authentication to function
• We maintain the right to modify, suspend, or discontinue any aspect of the service at any time

3. Age Restrictions and Eligibility

You must be at least 13 years old to use this service. If you are between 13 and 18 years old, you must have parental or guardian consent to use the service. By using the service, you represent and warrant that you meet these age requirements and have obtained any necessary parental consent.

4. User Accounts and Responsibilities

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Providing accurate and current information
• Notifying us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

5. Content Restrictions and Policy

Subtitle Pro is not responsible for the content of the Service's users. You expressly understand and agree that You are solely responsible for the Content and for all activity that occurs under your account, whether done so by You or any third person using Your account.

You may not transmit any Content that is unlawful, offensive, upsetting, intended to disgust, threatening, libelous, defamatory, obscene or otherwise objectionable. Examples of such objectionable Content include, but are not limited to, the following:

• Unlawful or promoting unlawful activity
• Defamatory, discriminatory, or mean-spirited content, including references or commentary about religion, race, sexual orientation, gender, national/ethnic origin, or other targeted groups
• Spam, machine – or randomly – generated, constituting unauthorized or unsolicited advertising, chain letters, any other form of unauthorized solicitation, or any form of lottery or gambling
• Containing or installing any viruses, worms, malware, trojan horses, or other content that is designed or intended to disrupt, damage, or limit the functioning of any software, hardware or telecommunications equipment or to damage or obtain unauthorized access to any data or other information of a third person
• Infringing on any proprietary rights of any party, including patent, trademark, trade secret, copyright, right of publicity or other rights
• Impersonating any person or entity including Subtitle Pro and its employees or representatives
• Violating the privacy of any third person
• False information and features

Subtitle Pro reserves the right, but not the obligation, to determine whether or not any Content is appropriate and complies with these Terms, refuse or remove this Content, and limit or revoke the use of the Service if You post such objectionable Content.

6. Intellectual Property Rights

6.1 Your Content

You retain ownership of all content you upload to the service, including videos and any text you provide. By using the service, you grant us a limited license to process your content solely for the purpose of providing subtitle generation services.

6.2 Generated Subtitles

You own the subtitles generated from your content. We do not claim ownership of the subtitles created for your videos.

6.3 Our Service

The Subtitle Pro service, including its design, functionality, and underlying technology, is owned by us and protected by intellectual property laws. You may not copy, modify, or reverse engineer our service.

7. Credit System and Payments

7.1 Credit Usage

Credits are required to process videos. Credit consumption is based on:

• Video length
• Video quality (SD, HD, or Full HD)
• Processing requirements

Credits are deducted when video processing begins. Failed processing attempts will result in automatic credit refunds.

7.2 Credit Types and Expiration

• Trial Credits: 5 credits provided initially for new users
• Subscription Credits: Roll over up to 2x your monthly plan allocation
• One-Time Purchase Credits: Do not expire unless combined with a canceled subscription

7.3 Refund Policy

• Subscription Plans:
  • First Purchase: 7-day satisfaction guarantee for unused credits (no credits used)
  • Subsequent Charges: Refunds only if cancellation request is received at least 48 hours before the next billing cycle AND no credits have been used since the last billing cycle
• One-Time Purchases: 7-day refund window for unused credits
• Used credits are non-refundable
• Refund requests must be submitted to our support team

7.4 Payment Processing

All payments are processed through Stripe. By making a purchase, you agree to:

• Provide accurate payment information
• Accept our payment processor's terms and conditions
• Pay all charges incurred under your account

8. Data Protection and Privacy

8.1 Data Collection

We collect and process data as described in our Privacy Policy. This includes account information, usage data, and content you upload for processing.

8.2 Data Retention

We retain your data for as long as necessary to provide our services and comply with legal obligations. You may request deletion of your data by contacting our support team.

8.3 Data Security

We implement reasonable security measures to protect your data, but cannot guarantee absolute security. You use the service at your own risk.

9. Service Level Agreement

9.1 Service Availability

We strive to maintain high service availability but do not guarantee uninterrupted service. The service may be temporarily unavailable due to maintenance, updates, or technical issues.

9.2 Processing Times

Processing times vary based on video length, quality, and server load. We do not guarantee specific processing times.

9.3 Service Modifications

We reserve the right to modify, suspend, or discontinue any aspect of the service at any time with reasonable notice.

10. Account Termination

10.1 Termination by You

You may terminate your account at any time by contacting our support team. Upon termination, your access to the service will cease, and your data will be handled according to our data retention policy.

10.2 Termination by Us

We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or for any other reason at our sole discretion. We will provide reasonable notice when possible.

10.3 Effect of Termination

Upon termination, your right to use the service ceases immediately. We may delete your account data after a reasonable period, subject to our data retention policy.

11. Limitation of Liability and Disclaimers

11.1 Service Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE.

11.3 Maximum Liability

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

12. Third-Party Services

12.1 Canva Integration

Our service integrates with Canva's platform. Your use of Canva is subject to Canva's terms and conditions. We are not responsible for Canva's service availability or functionality.

12.2 Third-Party Links

Our service may contain links to third-party websites or services. We are not responsible for the content or practices of these third parties.

13. Dispute Resolution
